Terms of Service

Welcome to PayCheckR, operated by Go Figure Payroll Pty Ltd (ACN 698 444 834) ("Go Figure Payroll", "we", "us", "our"). By accessing or using PayCheckR ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. About the Service

PayCheckR is a pay-checking tool that compares your reported pay against minimum rates set by Modern Awards and Enterprise Agreements as published by the Fair Work Commission. The Service is designed to help workers in Australia identify potential underpayments.

2. Not Legal or Financial Advice

The information provided by PayCheckR is for general informational purposes only. It does not constitute legal, financial, tax, or professional advice. PayCheckR does not replace advice from qualified professionals such as lawyers, accountants, or the Fair Work Ombudsman.

While we strive for accuracy, award rates, penalty structures, and employment conditions are complex and change frequently. We make no guarantee that results are complete, current, or error-free. You should independently verify any results before taking action.

3. Eligibility

You must be at least 16 years of age to create an account. By registering, you represent that all information you provide is accurate and that you will keep it up to date. Guest users may access limited features without an account.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to the Service or its systems
  • Scrape, copy, or reproduce the Service or its data for commercial purposes
  • Upload malicious files, false information, or content that infringes third-party rights
  • Interfere with the proper functioning of the Service

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with the Australian Privacy Act 1988.

7. Intellectual Property

All content, design, and software of the Service (excluding user-uploaded content and publicly available award data) is owned by Go Figure Payroll. You may not reproduce, distribute, or create derivative works without written permission.

8. Limitation of Liability

To the maximum extent permitted by Australian law, PayCheckR and Go Figure Payroll are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to:

  • Inaccurate pay calculations or rate data
  • Decisions made based on information provided by the Service
  • Loss of data or service interruptions
  • Any claims, disputes, or actions between you and your employer

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot be lawfully excluded.

Subject to the paragraph above, and to the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or in connection with the Service in any 12-month period is limited to the greater of (a) the total subscription fees you have paid us in the 12 months preceding the first event giving rise to the claim, or (b) AUD $100. Where the Service is a service not ordinarily acquired for personal, domestic, or household use or consumption, our liability for a failure to comply with a consumer guarantee is, at our option, limited to supplying the Service again or paying the cost of having the Service supplied again (section 64A ACL).

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Service Tiers and Pricing

PayCheckR offers free and paid subscription plans. Features available under each plan may change at our discretion. Current plans and pricing are displayed on the Pricing page. See Section 11 for billing, cancellation, refund, and price-change terms.

11. Subscriptions, Billing, and Cancellation

(a) Plans. PayCheckR offers free and paid subscription plans. Current plans and prices are shown on the Pricing page and are in Australian dollars (AUD), inclusive of GST where applicable.

(b) Billing cycle and auto-renewal. Paid subscriptions are billed in advance on a recurring monthly or annual basis (as you select at checkout) by our payment processor, Stripe. Your subscription will automatically renew at the end of each billing period using your saved payment method, until you cancel.

(c) Free trials. Where a free trial is offered, your subscription converts to a paid plan at the end of the trial and your saved payment method will be charged unless you cancel before the trial ends. Trial terms (length, eligibility, plan price after trial) will be displayed at sign-up.

(d) Cancellation. You may cancel your subscription at any time from your account Settings or by emailing hello@mypaychecker.com.au. Cancellation takes effect at the end of the current billing period; your paid features remain available until then.

(e) Refunds. Subscription fees are generally non-refundable for the current billing period. We will provide a pro-rata refund where we suspend or discontinue the Service through no fault of yours, or where required by the Australian Consumer Law (for example, where the Service has failed to meet a consumer guarantee under sections 60-62 ACL and the failure is major).

(f) Price changes. We may change subscription pricing from time to time. We will give you at least 30 days' notice by email before any price change takes effect for your subscription. If you do not accept the new price, you may cancel before the change takes effect. We will also provide reasonable notice before removing features from a paid plan.

(g) Failed payments. If a renewal payment fails, we may retry the charge and suspend access to paid features until the payment succeeds. We may cancel a subscription that remains unpaid for more than 14 days.

(h) Disputes and chargebacks. If you believe a charge is incorrect, please contact us at hello@mypaychecker.com.au before raising a chargeback so we can resolve it directly. Raising a chargeback for a charge that is properly owed may result in suspension of your account.

(i) Tax invoices. Tax invoices are issued via Stripe and are available from your account billing portal.

12. Termination

We may suspend or terminate your account at any time if you breach these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. Material changes will be communicated via email or an in-app notice.

14. Governing Law

These Terms are a contract between you and Go Figure Payroll Pty Ltd (ACN 698 444 834). They are governed by the laws of the State of Victoria, Australia, and the Commonwealth of Australia where applicable. You submit to the non-exclusive jurisdiction of the courts of Victoria for any dispute arising out of these Terms or your use of the Service.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision is to be read down to the minimum extent necessary to make it valid and enforceable.

16. Survival

Sections 2, 6, 7, 8, 9, 14, and any provisions which by their nature should survive termination, will survive termination of your account or these Terms.
