About Leave Entitlements in Australia
Under the National Employment Standards (NES), full-time and part-time employees in Australia are entitled to several types of leave:
| Leave Type | Details |
|---|---|
| Annual leave | 4 weeks per year of service (5 weeks for shift workers). Accumulates based on your ordinary hours and is paid at your base rate plus any applicable leave loading (typically 17.5% under most Modern Awards). |
| Personal / carer's leave | 10 days per year, used for illness, injury, or caring for a family member. Accumulates year-on-year and is not typically paid out on termination. |
| Long service leave | Governed by state and territory legislation, not the NES. Typically 8.67 weeks (2 months) per 10 years of continuous service. Eligibility thresholds and pro-rata rules vary by state — Victoria and ACT allow access from 7 years, while most other states require 10 years (with pro-rata on termination from 5–7 years). |
| Casual employees | Do not accrue annual or personal leave, but may be entitled to long service leave in some states after the qualifying period. |
